Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") are a binding agreement between BOOK CREW LLC ("BookCrew", "we", "us") and the person or entity ("you", "Business User") that creates an account or uses the BookCrew platform at getbookcrew.com and related services (the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services. These Terms govern your use of the platform; messaging to end customers is also governed by our SMS Terms and Privacy Policy.

2. Definitions

"Business User" means a service business (and its authorized staff) that uses BookCrew to manage scheduling. "End Customer" means an individual who books an appointment through a Business User's BookCrew page. "Content" means data, text, and materials submitted to the Services.

3. Eligibility & Accounts

You must be at least 18 and able to form a binding contract. You are responsible for the accuracy of your account information, for all activity under your account, and for keeping your credentials secure. Notify us promptly of any unauthorized use.

4. The Services

BookCrew provides appointment scheduling, customer management, automated SMS/email notifications, payment facilitation, and related tools for service businesses. We may add, change, or remove features over time. The Services are provided on an "as available" basis.

5. Subscriptions, Fees & Billing

Paid plans are billed in advance on a recurring basis (monthly or as stated at sign-up) through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Fees are exclusive of taxes, which you are responsible for. Subscriptions auto-renew unless cancelled before the renewal date. Except where required by law, fees are non-refundable, including for partial billing periods. We may change pricing with at least 30 days' notice; changes take effect at your next renewal. BookCrew business subscriptions are paid from the first month: there is no free trial of a paid plan and no automatic charge following a trial. Any demo access is non-functional and provided for evaluation only. (Affiliate "design preview" trials are a separate program governed by the Affiliate Agreement, not these Terms.)

6. Acceptable Use

You agree not to: (a) use the Services for unlawful, harmful, or fraudulent purposes; (b) send spam or messages without proper consent; (c) violate the rights of others; (d) attempt to gain unauthorized access to the Services or interfere with their operation; (e) reverse-engineer or resell the Services except as expressly permitted; or (f) use the Services to send prohibited content (including illegal, hateful, or carrier-restricted SHAFT content). We may suspend or terminate accounts that violate this section.

7. Messaging Compliance & End-Customer Consent

You are solely responsible for your communications with your End Customers. You represent and warrant that, before collecting a phone number or sending any message through the Services, you have obtained all consents required by applicable law (including the TCPA and carrier/CTIA requirements) and that you will honor opt-out requests. You will not use the Services to message individuals who have not consented or who have opted out. You are responsible for the content of messages you configure or send. BookCrew provides tools to facilitate compliant messaging but is not responsible for your failure to comply.

8. Customer Data

As between you and BookCrew, you own the Content you and your End Customers submit. You grant us a license to host, process, and transmit that Content solely to provide and improve the Services. We handle personal information as described in our Privacy Policy. You are responsible for having a lawful basis to collect and share End Customer data with us.

9. Intellectual Property

BookCrew and its licensors own all rights in the Services, including software, design, and trademarks. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services per these Terms. You retain no rights in the platform itself.

10. Third-Party Services

The Services rely on third parties including Twilio (SMS), SendGrid (email), Stripe (payments), Google (calendar), and Anthropic (AI features). Your use may be subject to their terms, and we are not responsible for their acts or omissions.

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or that messages will be delivered without delay, as delivery depends on carriers and third parties.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKCREW WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You will indemnify and hold harmless BOOK CREW LLC and its members from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Services, your Content, your messaging to End Customers, or your violation of these Terms or applicable law.

14. Term & Termination

These Terms apply while you use the Services. You may cancel at any time; cancellation stops future renewals but does not refund amounts already paid. We may suspend or terminate your access for violation of these Terms or non-payment. Upon termination, your right to use the Services ends; sections that by nature should survive (including 7–13 and 16) survive.

15. Changes to These Terms

We may update these Terms. Material changes will be posted with an updated date and, where appropriate, notified to you. Continued use after changes take effect constitutes acceptance.

16. Governing Law & Disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the state and federal courts located in New Jersey for any dispute not subject to other agreed resolution.
